Abstract

Institutions which are equipped with a qualified autonomy have a strong need to settle disputes and conflicts prior to use of the courts to regulate out of court (operationally in house). It is therefore no coincidence that the out-of-court settlement of disputes, in which concrete form, gains in importance. The Fachhochschul-Sektor is predominantly organised under private law which establishes the legal framework to his students in the context of so-called training contracts. It is debt agreements. The need of the Fachhochschul-Sektor, disputes arising from the training contract to settle extrajudicial, has its traceable cause in need of quicker and more straightforward execution. The use of government assistance is connected with a more time, what the need for speedy completion is not always fair. A rapid completion, that takes incount both the valuable life and livetime-incoming the students. The following contribution explores possibilities and barriers for out of court settlement.
